The terms governing use of this website and visits to venues operated by NFT ART GALLERY LLC.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a binding agreement between you and NFT ART GALLERY LLC ("we," "us," or "our"), located at 3190 N Ridge Rd, Vermilion, Ohio 44089, United States. By accessing this website, purchasing admission, or visiting a venue we operate, you agree to these Terms and to our Privacy Policy.
If you do not agree to these Terms, do not use this website. If you are using this website on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. About Our Services
We operate cultural venues and attractions, including (without limitation) art galleries and art museums; history, science, specialty, and multidisciplinary museums; halls of fame; planetariums and observatories; mobile museums and traveling exhibits; archeological sites, battlefields, forts, historic ships, and heritage villages; zoos, safari parks, aquariums, aviaries, botanical gardens, arboreta, and other living collections; and national, provincial, and nature parks, preserves, conservation areas, sanctuaries, interpretive centers, and natural-wonder attractions.
Information on this website — hours, programs, exhibitions, pricing, and availability — is provided for general informational purposes and may change without notice. Please confirm details with us before traveling.
3. Website Use
- You must be at least 13 years old to submit personal information through this website.
- You agree to provide accurate information in forms and correspondence, and to keep it updated.
- You will not misuse this website — including attempting unauthorized access, disrupting site operations, scraping content at scale, or submitting unlawful, defamatory, or deceptive material.
- Submitting an inquiry does not create a booking, admission, or any contractual relationship until confirmed in writing.
4. Venue Admission and Conduct
- Admission, where required, is granted for personal, non-commercial visitation unless otherwise authorized in writing.
- Visitors must comply with posted rules, staff instructions, and safety barriers at every venue.
- We reserve the right to refuse admission to, or remove, any person whose conduct endangers visitors, staff, collections, animals, habitats, or historic fabric.
- Bags may be subject to inspection; prohibited items (weapons, drones, etc.) must comply with posted policies.
- Children must be supervised; group leaders are responsible for their group members.
5. Collections and Exhibits
- Do not touch objects, artworks, specimens, or exhibit surfaces except in designated interactive areas.
- Loaned and owned collection items are protected; damage caused by negligence or misconduct may result in liability for restoration or replacement costs.
- Exhibitions may close, rotate, or travel without notice; inclusion in a visit cannot be guaranteed.
6. Living Collections and Outdoor Sites
- At living-collection venues (zoos, aquariums, aviaries, gardens), do not feed, harass, or touch animals or plants except in designated, staff-supervised areas.
- Outdoor venues — parks, preserves, sanctuaries, caverns, waterfalls, battlefields, and archeological sites — involve natural hazards. Visitors proceed at their own risk and must stay on marked routes.
- Removal of plants, rocks, artifacts, or other natural or cultural material is prohibited.
- Weather, animal welfare, and conservation needs may require closures or route changes without notice.
7. Group and Program Bookings
- Group, school, tour, and traveling-exhibit bookings are confirmed only by written agreement specifying dates, capacity, and fees.
- Cancellation, deposit, and rescheduling terms are set in each booking agreement.
- Programs may be modified to accommodate collections care, staffing, weather, or safety requirements.
8. Photography and Recording
- Personal, non-commercial photography is generally welcome where posted signage permits; flash, tripods, and professional equipment may be restricted.
- Commercial photography, filming, and media production require prior written permission.
- Some exhibitions — particularly loaned works — may prohibit photography entirely; comply with all signage.
9. Intellectual Property
All content on this website — text, graphics, layout, and design — is owned by or licensed to NFT ART GALLERY LLC and protected by intellectual-property law. Artworks, artifacts, and exhibits depicted or discussed remain the property of their respective rights holders. You may view and print pages for personal, non-commercial use only; any other reproduction, distribution, or derivative use requires our prior written consent.
10. Third-Party Links
This website may contain links to third-party websites or services (including partner venues, ticketing providers, and web resources). We do not control and are not responsible for third-party content, practices, or policies. Accessing third-party sites is at your own risk.
11. Disclaimers
- This website and its content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
- Venue information (hours, programs, exhibitions) is subject to change; reliance on it is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, NFT ART GALLERY LLC and its members, managers, employees, and agents shall not be liable for indirect, incidental, consequential, special, or punitive damages — or for lost profits, data, or goodwill — arising from your use of this website or visits to our venues. Our total liability for any claim related to this website shall not exceed the amount you paid us for the relevant service, if any.
13. Indemnification
You agree to indemnify and hold harmless NFT ART GALLERY LLC from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of this website, or violation of venue rules or applicable law.
14. General Provisions
- Governing law: These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Venue-related claims are subject to the law of the venue's jurisdiction.
- Changes: We may update these Terms at any time; changes take effect upon posting. Continued use of the website constitutes acceptance.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- No waiver: Failure to enforce a provision does not waive our right to enforce it later.
- Entire agreement: These Terms, together with the Privacy Policy and any written booking agreements, constitute the entire agreement between you and us regarding this website and our services.
